Open Question: I have central air in my home. About 1 month ago, the upstairs unit stopped working. I called a repair man.?

He came and changed the dielektrol capacitor. (when he removed it, it had swelled to the point of near explosion). He said that happens from time to time. Anyways, now my first floor a/c unit has stopped working (the fan outside won't spin---which is exactly what happened to the unit on the 2d floor last month). I opened up the back of the unit which is outside in my yard and looked at the capacitor. It is not swollen and looks fine. However, I realize it could still be blown. I live in Round Rock Texas. Does anyone know of a company who will sell me a dielektrol capacitor (since I am not a licensed contractor), about what price should I expect to pay, the model number is ck-j49-1AB, and if there is any other thing I should be checking to try and self-diagnose this problem. I looked at the breaker and it appears to be fine. Thanks.  more

Open Question: a contractor must pay a $40,000 penalty if construction of an expensive home requires more than 16 weeks.?

He will receive a bonus of $10,000 if the home is completed within 8 weeks. Based on experience with this type of project, the contractor feels there is a 0.2 chance the will require more than 16 weeks for completion, and there is a 0.3 chance it will be finished within 8 weeks. If the price of the home is $350,000 before any penalty or bonus adjustment, how much can the buyer expect to pay for her new home when it is completed? Please help!  more

I was laid off from my job in February and have been collecting since the beginning of April, I do have a P/T job with the Home Shopping Network doing orders/CS from my home, they do take out for unemployment and other taxes, it is not a independent contractor position, my hours vary greatly from week to week, one week I may get 35 hours but the next week I may only get 7 or 8. Every week they have been taking an amount out of my unemployment check, I was wondering if after 26 weeks if there is still money on my claim will I get that money? if I was able to get more hours and unemployment starts taking less out of my check will the benefits last for a longer period of time? There are contractors that are working on my apt and they are destroying my home. They have left rusty nails and screws and plaster in a pile on my floor they move my furniture and dont put it back. In fact when they moved my furniture the other day and dropped all of the pictures and air freshner on the floor and left there put my curtains up and left it like that so everyone can see in my home. And my XBOX is missing on the same day. Also they chipped the varnish on my TV stand when they moved it .So i call my rental office and they told me that the contractors supervisor will meet me on Tuesday morning so i waited and was late for work the supervisor never showed up. Well it Thursday nothing yet, Property Manager says that the contractors will call me well i am sick and tried. I want to know what can i do call a lawyer? If you would have answered my email back in May, I wouldn’t have asked Mr. Michael Anthony of the title agency, and Mr. Anthony wouldn’t have told me that you did owe me a copy of the appraisal, and I wouldn’t have had to ask you again. So thank you for being prompt and professional by answering my email 2 months after I originally asked you. It looks like (yet again) that we are back at square one. Suntrust Mortgage has created yet another big problem for us. We are requesting the $6415.15 (which is the remaining portion of the $13,000.00) to pay the contractor’s bills for work/s they have completed and to also obtain their releases to obtain the “CO” from Hillsborough County. Be aware that I do not have the exact amounts for the contractor’s bills. If you want that information, please call Mr. Chris Braglin from Braglin Builders INC. at 813-695-0685. Again, I do not know the exact amounts for the contractor’s bills, so don’t ask me because you already have my answer. These are the contactor’s that I am aware of that need payment: 1) Sal Electric: Electrical contractor that has performed the electrical work for our house. 2) A/C Contractor: A/C contractor that has performed the A/C work for our house. 3) Euro-Shutters: Hurricane shutter contractor that has performed the work for our house. 4) TECO: Local electrical power supply company. A certain amount must be paid before they do the final connection/meter installation to the house. 5) Hillsborough County Government: They require a certain amount of money to be paid for “Impact Fees” and/or etc… before they provide and/or release the “CO”. 6) Landscaping: Hillsborough County Government requires a certain amount of trees, grass, driveway and/or etc… before they provide and or release the “CO”. 7) Others: If any you can obtain those from builder. Before we started the process/hassle to request the $13,000.00, we had an ending balance of $3,766.03 (according to Ms. Irene Hooper office meeting on Tuesday, March 24, 2009 at 11:00AM EST) bringing our total to $16,766.03. Your company led us to believe that we were going to receive the $13,000.00 that we had requested, and maintain the balance of $3,773.03. If you, or someone else in your company, would have followed their legal obligation of informing us that we would only receive $6,584.85 (0.506%), and you and your company would be holding the remaining $6,415.15 (0.493%), we would have most definitely went another route. I don’t understand how you and your company, fully knowing that we were approximately $13,000 short of finishing the construction of our home, let us apply for the $13,000 we need to finish our house, only to give us half and leave us in the exact same position (if not worse) then we were in before we applied for the increase. We feel that your company intentionally tricked us. We do not like this situation at all and it doesn’t look like it’s going to end favorable. Like we have said before, and like we are saying again now, we do not have the money to pay out and wait for you and your company to reimburse us. On top of those fiascos, you and your company want inspection after inspection after inspection after each “penny” draw for $500 a pop! We already don’t have the money to pay the electricians, the euro-shutter guys, the a/c guys, TECO, Hillsborough County, and all the landscaping things the county requires to obtain the “CO”, and you and your company wants to make the situation worse by charging us $500 for each “penny” draw? All of these inconveniences are going to cause my builder to pass the extension date of August 1st and then we will have to pay you and your company another $150 to receive another extension. Like you and your company aren’t making enough money off the interest we are paying on the mortgage! You and your company LOANED us the money for the house and most of these delays/problems we have been having were cause by you and your company changing our contract managers every couple of months. It’s become pretty clear that you and your company orchestrated these events to keep on ******* us. We aren’t going to suggest anything. Tell us what you and your company is going to do (or not do) to solve this mess, since no matter what we try to do to get things going and get our house finished, you and your company finds another way to **** us. I have been working full time for 22 years as a medical secretary, office manager for the same boss. Today he tells me he is going to make me an independent contractor working 18 hours so that he does not have to pay any taxes, including corporation tax. I need my money and have never been an independent contractor. I am in the process of selling my home and moving. But in the meantime I am still running the office and have not quit yet, until I know that everything is OK for me to leave. I have to train another person for my position too. It is a very responsible job and a one girl office. I do not wish to be an independent contractor and I do not wish to quit, until it is time. Who can I report him to? The Labor Board? Social Security? Unemployment? IRS? I do not know. I know he is taking advantage of me and being a bully. I have never tried to get anyone in trouble but this is very unfair. All those 22 years working six days a week. Is there anyone that I can turn to for help that he does not get away with this? At least I should be entitled to unemployment. Open Question: Independant Contractor for Direct Sales COmpany- company thinks my clients are theirs.. please help asap?

I worked for over a year for a company as an independant consultant (it was doing in home shows selling products). anyways, I am no longer working for them. I did sign a non-compete agreement with them- but only 3 weeks before I left. After advice of my lawyer (because their non compete agreement wouldnt hold up in court for anything- they didnt know what they were doing when they wrote it-or stole it from someone else) anyways- under his advice- i sent them a letter stating why i was terminating my contract with them (they didnt give me everything the contract said i would get too).. However, i recently received a letter from their lawyer saying that I need to provide them with my contact lists and clients. I remember my lawyer saying something about that because i was an independant contractor and went out and got my own clients (ie the company didnt provide me with a client or lead list or anything) that technically they are mine and I am free to 'take them with me". Right now I don't have money to pay to go see my lawyer again- but need to get a letter back to them asap. Anyways- do any of you know any laws or case law or anything pertaining to how that works? I used my own money to go and promote myself and build a rather large customer base.. I don't possibly see how they can say that legally they are theirs!  more

Open Question: My contractors won't listen to me?

We are having a new home built, but first a bridge needs to be put in. The creek that it crosses runs really low, but when backwater from the river rises it gets extremely high. Our contractors have put in a 5' culvert, and it is too small. Three of our future neighbors have stopped by and told the contractor that it will wash out the first time the river rises. One of those neighbors (my dad) has let my husband know that it is not a wise idea. We will probably be putting in a NEW bridge before our home is finished. So we called our contractor (who outsourced the bridge job), who says that he hired this guy to do it because he doesn't know how to do it himself... "it's his baby", he says. If this creek backs up, it will flood the home next to us, and quite possibly our own. I want this guy to pull the culvert out and do a steel i-beam bridge-- but don't feel that they should charge me for their first mistake. What now?  more

I wrote him three letters about this and he still wants to file a lien on my home; he claims that i owe him over $2000. dollars. Open Question: Can I refuse to pay my rent?

The apartment building I live in has serious roof damage and needs repair. I informed the leasing company of a leak in my family room last August and again in September. The first week of February they told me that someone would be out to make repairs to the roof the following weekend and I was advised not to pay my March rent. As of April 1st the leak was still present and I was told not to pay my rent again. On May 1st a different management company took over to manage the building for the bank, as the owner filed bankruptcy - they have been out to "inspect the unit" twice since then. Last week my daughter and I came home to find a "severe infestation of carpenter ants" - per the RECEIPT the exterminator gave me - the exterminator that the management company believes I should not have called because they were going to take care of it the next day (I knew they intended on taking care of it the next day, but not until 3 HOURS AFTER I called their "emergency" number). The ants were coming in through a roof access panel above a door opening into my kitchen - per the exterminator, the spray he used will keep the ants away for up to 4 mos. but they will come back if the roof isn't taken care of. According to the new management company, the bank doesn't own the building yet and so cannot hire a contractor without first going to court. Meanwhile, I have to plan my life around the weather so I can change out a drip bucket, and worry about destructive insects.  more

Resolved Question: Legal Question about Harassment and...?

Please bare with me, this is a little complicated. I have a friend who ordered a kitchen appliance from a well known big name store. The men showed up to deliver and install the appliance, and one of the workers begn to harass my friend. He became sexually explicit, asked about the pictures of her children, and began to speak derogatorially about them. He commented on her body, her home, her family. She asked him to leave, called the store immediately, and called the police. The worker told her he would make sure to keep her address, as he would be back for her. She is basically scared to death. She has police patroling her street several times a day. She won't even take her children to the park. She is asking for the delivery fee back, due to the situation. She contacted the store where she purchased the appliance, and they said that they are not rsponsible because they hied a sub-contractor to do the install. The sub-contractor said they are not responsible, because they too hired a sub-contractor. The third sub-contractor said he too is not responsible because the men who he hired to deliver and install the appliance were not his employees. They were hired off the street in front of one of the large home improvement stores. (they are illegal immigrants). Now the guy who harrassed her has been contacted, and openly admits what happened. He basically said he remembered exactly who she is and where she lives, which is freaking her out even more. At this point she has contacted a lawyer, or two, who say they would take the case, and try to sue the big name store, but they want their fees up front, and she can not afford that. I am wondering who exactly is reponsible,and what can be done to make her feel whole. She is a young mother and wife, and feels like she is living in a horror movie, always watching over her shoulder, afraid to go out the front door thinking this man will be there waiting for her. She is afraid he will kidnap her children, etc. This may seem a bit far-fetched but she is a strong woman who is not usually fearsome. I know her well, and the man must have really creeped her out, for her to persue this to this point. Any help you could offer, would be great.  more

Voting Question: If seller won't vacate on agreed upon closing date, what remedy should we request?

We did what was supposedly our "final walkthrough" of a home we're purchasing today - closing is on Monday a.m. first thing. The contract states that seller must vacate the property at closing, and remove all personal items not sold with property, and all debris. The seller was still living in the home, and had considerable personal property still in the home, and considerable mess, as well. It seems unlikely that he will be able to remove everything by Monday morning. What is the best remedy? What financial consideration should we request if seller wants to move the closing back (while we were not set to move in immediately, we did have contractors coming immediately to do repairs on the home, so they would be complete before our rental lease was over).  more

I recently took a contractor job(temp) paying $22 per hour, the agency offers insurance, but no other benefits. There is a possiblity to go perm with this company, a very large company in San Antonio, but I understand the pay will not be lateral if I'am hired perm. This company is very structured, I'm not use to being monitored constantly. I also got an offer with a large texas based bank, permanent position with benefits, but the pay is like $10K a year less, however its closer to my home and the enviroment is much nicer and laxed.  more

I have a problem with my husband. I'm at the point that it has been extremely difficult to deal with him. We have been married for almost 8 years and most of that time we have been apart due to him in Iraq as a soldier or a civilian contractor. The time we have been together when his is home we have fought because he screwed up with finances and such. He has done some terrible things to me and I have come to the point in my life that I have told him while he is in Iraq that he needs to try to start just being my friend and from there we may work on our marriage. At the same time, I have told him that I need to work on me. I feel in my heart I need to get me straight and truthfully I need to work on me before I can even think about us. He has stated the same thing, but seems to push to work on us right now. We have two children together 6 and 2. There is that part of me that loves him and that mainly has to do with our children. The other part doesn't even trust him with anything much less my heart. Point being, my question is, how do I get him to understand that I need to fix me and my issues before I can even focus on our marriage? And am I selfish that I need to focus on me with family not helping much. They state that I just need to learn to figure out and take care of all things while tended to two small children and full time school. (Also stresses about hubby in Iraq) What do I do? How do I work all this out. I'm losing ground. The fact of the matter is he is not pulling away. He is pushing extremely hard and he knows that I have a male friend from when I was like 9 and he is jealous, when he has no reason to be.  more

Resolved Question: What is this sprinkler box, and why did it cause my sprinkler system to come to life?

OK, let me start off by saying that I don't know much, if anything, about sprinkler systems. My house had an existing, inoperable sprinkler system that had previously been controlled by a Toro "Moist-O-Matic" control box. The box apparently controlled zones in the front and back yard. Well, it had been electrically disconnected for some time, and after some sprinkler contractors came to my house to give me an estimate on a new system, the control box had been broken off my house. Dangling for several months, I decided to cut the four rubber lines it was attached to (that ran into the ground) so that I could remove the box and make the back of my house a little nicer. My neighbor (who works for Home Depot) came over and helped me fix it. We turned off the city water, cut the sprinkler pipe and capped it with glue. We turned the water back on, and 1 more sprinkler came on. This went on for 3 hours, into the night, with one sprinkler coming on after the last had been capped. At the very end of the night, we believed the problem had been all but contained, but there was a small leak somewhere. We found the same rubber tubes running parallel to the normal sprinkler system PVC in the ground and were able to stop their leaking with small screws. My husband and I have only been married 4 months. My husband is deploying at the end of July to Afghanistan for 6 months. He is not active duty, he is an army contractor. However, I keep dealing with crazy emotions from crying, to anger, to outright rage at the thought of his leaving for that long time. He was not expecting a deployment this soon, but he has no choice even though he is civilian. My family wants me to stay with them for a few months. But we just moved to another state and this is my home now. I want to stay here. However, I know my family will try to take over. Between the fact that my new hubby won't be here AND dealing with my family, I am very stressed. I can't imagine life without him. I am angry, scared, unhappy. I try to be strong when I'm talking to him, but some moments I want to scream and break mirrors. Other times I think I'll puke cuz I'm crying so hard (while he is at work of course). I had never planned on marrying a man who would deploy. But I know God brought us together. I am concerned for his safety too. This world is so dangerous. There are the practical things that I don't know how to get through. No sex, me alone in a big bed, eating alone, going to church without him, handling financial things, dealing with family stuff (birthdays, conflicts, etc). I have never lived on my own ever. I went straight from my parents house, to college (home on weekends), back to my parents house, and into this marriage.  more

Voting Question: Where can I leave online feedback for services like plumbers and other service companies?

I moved to what might be called an upscale neighborhood, and I already have evidence that two service companies tried to rip me off by overcharging and/or trying to sell me unneeded parts. I have the evidence and one company admitted they made a 'mistake.' My theory is that since the area is upscale, and has busy 'white collar' professionals, heating & plumbing and other service companies figure they can overcharge without questioning from the consumer because people are either too busy or don't know a lot about technical home upkeep problems. Is this possible? I never had this type of problem before. But being from a working class family (my father was a contractor), I have perhaps a bit more of an idea regarding what is the truth and what is B.S. in this area. I challenged both companies already, and they said they made a 'mistake.' Yea, right! Is there a way I can record my experiences on the web. The companies themselves won't be too keen about accepting the kind of feedback I think they deserve, and if they read what I wrote, I'd be happy to answer them since I plan to leave my name (or is that a bad idea)?  more

Voting Question: How to deal with incorrect indepedent contractor status?

I was laid off a lil bit ago and just found a new job - a contract position. They train me, give me their laptop, make me use their methodology, develop my work schedule, reimburse me for practically all expenses and encourage me to work during specific hours. However, other than site visits I am working from a home office. All in all they are calling me an independent contractor and had me sign a paper that I would be responsible for all payroll taxes. Which is fine, other than that I would HATE to pay double FICA and stuff... I feel that based on the actual relationship I might have a case to be classified as an employee, but I feel that if I try to contest it now my contract will be immediately cancelled... I am getting 1099-MISC at year end from them so I was wondering if there was a way for me to pay ONLY employee payroll witholding portion now and claim employee tax status if audited by IRS (because hopefully then I will have another full-time job and my job security will not be affected!). I am getting 1099-MISC so I can see that being a huge problem because for all wages on 1040 you are supposed to attach W-2...But I dont see a point in doing Schedule C and SE because I do not have any unreumbursed expenses (maybe a 100 dollars!). All in all my question is - in this situation how do I only pay quarterly employee withholdings and postpone bringing the contractor/employee issue up with IRS as long as possible? Voting Question: How can I get out of this house?

My husband and I bought a manufactured home 4 years ago. The home is on a foundation, but of course the home is still movable. We want to keep the land that the home is currently on but have the home moved to another lot. After talking to a loan officer at the bank we have our mortgage through we had started making plans to build a home on the lot that the home is still on. The loan officer indicated all we need to do was refinance the home onto the other lot to release the lean on the property that the home is currently on. However, after finding a buyer for the home(once it was moved) ,finding a contractor to build our new home, buying blue prints, getting approved for the construction loan, and having all the people needed to move the manufactured home and pour footers and build the block ready to go, the same loan officer who told us all we had to do was refinance said oops she was wrong the mortgage has to be paid in full before the home can be moved. We are devastated and are still trying to make this happen. If a bank would let someone finance the home and lot based on what the home would appraise for after it is moved and set up, we could pay off the mortgage. The problem is I cant find any bank who is financing mobile homes . If anyone has any suggestions or ideas on how this could possibly work. I would very much appreciate any help. I dont want to build on the other lot. I live next door to my grandmother and I want and need to be close to her. Also we purchased the other lot with the sole purpose of moving the home on it. I wouldnt want to build there. Also I have all the money needed to move the home and build the foundation (8000$) and we would pay for that not the buyer!!  more

I am buying my house contract for deed. I pay mortgage, taxes, and insurance directly to the lady I bought the house from as stated in the contract. I have storm damage to my house so I called the adjuster from the home's insurance company. She met with my insurance consultant and ok'd everything. So, I hired a contractor and signed a contract for my roof and they finished my roof yesterday. The only problem is that my name isn't on the insurance policy for the home so I have to go through the person I'm buying it from. She is to receive the check from the insurance company since it is in her name, but she told me I have to pay outa pocket for this because my name isn't on the policy. She is refusing payment on anything done to my home. If I pay her the taxes/insurance on my home and am buying it-don't I have a right to say who is to be working on my home? What can I do?  more

Resolved Question: REO seller trying to back out of contract North Carolina?

I am currently under contract to purchase a REO owned by Fannie Mae. I am supposed to close in two days. Last week my agent had some contractors look at the house to give estimates. The contract started to do some work on the house without verbal or written authorization from either me nor my agent. The sellers agent contacted us immediately and the contractors were told to leave. My agent got into an argument with the sellers agent and it ended with the sellers agent saying we may cancel the contract and hanging up on my agent. Since then the broker in charge for my agent has been trying to get up with the sellers broker in charge. No response last Thursday. Last friday they made contact and said they are waiting to hear back from Fannie Mae's asset manager. Monday no response. Tuesday (today) still no word as of 10 a.m. I am supposed to close in 48 hours. Have put off the title search till i hear back. I already have almost 1,500 invested in commitment fees, home and pest inspections, appraisal, hvac inspection and pump inspection. Can the seller cancel this contract in North Carolina? Will I receive all my earnest money back ($5,000) AND the 1,500 invested. I heard of something called "specific performance" which could force the seller to sell? What do you think my options are? Has anybody dealt with REO's and Fannie Mae? I'm all set to close and both invested monetarily and with emotion now. Any advice would be appreciated. Thank you. Thanks for all the answers. Resolved Question: Home Inspector and Roof Insepctor?

Hi, I recently purchased a home in November 08. The A/C has had to be replaced and the roof now has to be replaced. I pretty much think my inspector did a bad job, wouldn't ya say? The inspector said my roof was from 1985 and that it would be fine for at least another 15 years. Before I bought the house I noticed a small leak in the garage. My inspector / licensed roofing contractor said it was from a sideways wind and came in through a vent on side of house and shouldn't be a problem. I then included in my contract for the home that a licensed roofer had to repair it before closing. The repair was made by whom I don't know, but my "inspector" came out and said it was fine. Since he is a licensed roofing contractor, it was approved. Now I have to replace the roof due to the leak and the old age of the roof. Now for the A/C the inspector said just clean out the system inside and it would be fine. Upon our first month of having to use a/c the system failed. Seemed like it was pumped full of freon before selling the house and the inspector looked right over this to. Is there anything i can do? I am in Florida  more

I'm a work-at-home freelancer for a small company that pays everyone on an hourly basis as an independent contractor. It works nicely--the firm's principals are easy to work with and there are a couple of dozen people with the same arrangement I have. About eight months ago they saw business drop off (recession related) and cut everyone's fees by 30%. They were very apologetic about it. Now, things are looking up a bit. I'd like to approach the Chief Operating Officer about raising my fees again. Of course, I'd like to go back to where I was but I'm willing to take something less. He and I get along well, but this conversation will have to be done via phone or email because we live hundreds of miles apart. My new home (built in 1943) has some items electrically grounded to the gas pipe. This did not seem safe to the general contractor who had inspected the home, however another general contractor said that this is common and actually should be done in some cases. (something about the gas pipe, water pipe, and ground rod all being connected to one another) The house does have a ground rod and when I replaced a couple of non-grounded receptacles I grounded them to the rod. Resolved Question: Will FHA loan fail due to missing shingles on roof?

Our bid was accepted on a HUD home, the appraiser was out last week, and we are awaiting his report. He noted shingles missing on the roof, but to me the roof does not look that bad, no water damage on the inside of the home. So will we not get the loan beacause of roof repairs? I know the seller won't fix the roof, we have the money to fix the roof, will HUD let us hire a contractor for the repairs? I am just wondering if we close the loan and then escrow money for the repairs, It took three weeks to get the appraisal, no one will give me an answer they say just wait, and see. I just wonder if repairs cited on the FHA appraisal report have to be fixed prior to close, are we allowed to fix them, or do we just get denied? Who gets the apprasers report, our realtor or banker? Then do we negotiate with HUD. I know the home appraises for what our offer is, it just needs minor repairs.  more
